Illinois Marijuana Laws for Home Cultivation and Medical Use in 2021

Illinois might have taken its sweet time with marijuana reform, legalizing medical marijuana only in 2013 and recreational in 2020 but it caught up in a big way after it became the first state to legalize commercial sale of recreational cannabis through state legislature. This move seems to be paying off since it was reported that the state’s recreational marijuana sales reached as high as $44 million even during the coronavirus pandemic.

Here are some notes about Illinois marijuana home grow and medical grow laws:

*The Illinois General Assembly passed the Compassionate Use of Medical Cannabis Pilot Program Act in 2013 (MCPP) but the law was highly restrictive. The state’s medical marijuana program was only expanded in 2018 when Gov. J.B. Pritzker signed legislation allowing additional qualifying conditions.

* The Illinois General Assembly passed in 2019 the state’s Cannabis Regulation and Tax Act which legalized recreational marijuana starting January 1, 2020.

*Only registered medical marijuana patients and caregivers may cultivate cannabis at home, limited to 5 mature plants.
